DaySpeak Terms of Service

These Terms of Service ("Terms") explain the rules for using DaySpeak.
Please read them carefully. By using DaySpeak, you agree to these Terms. If you do not agree, do not use DaySpeak.

1. Who we are
DaySpeak is operated by [Legal name / developer name] ("DaySpeak," "we," "us," or "our").
DaySpeak is a private journaling app that helps you capture your day using voice, text, photos, videos, and gentle reflections.
2. Using DaySpeak
You may use DaySpeak for personal journaling, reflection, and related personal use.
You agree to use DaySpeak in a lawful, responsible way and in accordance with these Terms.
You are responsible for your device, your account, and the content you create or import into DaySpeak.
3. Your account
Some DaySpeak features may require an account.
You agree to provide accurate account information and to keep your sign-in credentials secure.
You are responsible for activity under your account, unless the activity was caused by our failure to protect the service.
If you believe your account has been accessed without permission, contact us.
4. Your content
Your journal content belongs to you.
This includes entries, text, photos, videos, imported content, and other material you create or add to DaySpeak ("Your Content").
You are responsible for Your Content and for making sure you have the right to store, upload, import, export, or share it.
By using features such as Cloud sync, AI insights, feedback, import, or export, you give DaySpeak permission to process Your Content only as needed to provide those features.
We do not own your journal content.
5. Local data and Cloud sync
DaySpeak may store content locally on your device.
If DaySpeak Cloud sync is on, eligible content such as journal text, photos, videos, and related metadata may sync to your DaySpeak account.
Raw voice recordings stay on your device by default and are not synced to DaySpeak Cloud.
If you turn Cloud sync off, new entries, photos, and videos will still be saved, but only on your device unless you turn sync back on.
You are responsible for maintaining access to your device and account. Exported files should be stored carefully if you want to keep separate backups.
6. Voice transcription
DaySpeak may provide voice transcription features that turn speech into text.
Transcription may not always be accurate. You should review and edit your journal entries as needed.
Transcribed text may become part of your journal content and may sync if Cloud sync is on.
7. Gentle AI insights
DaySpeak may offer Gentle AI insights, including summaries, reflections, themes, or weekly/monthly insights.
AI insights are designed to support personal reflection and writing.
AI insights are not medical advice, mental health treatment, diagnosis, legal advice, financial advice, or professional advice.
Do not rely on DaySpeak for emergencies, crisis support, diagnosis, treatment, or professional decision-making.
You can turn Gentle AI insights off in Privacy & Lock.
8. Feedback
If you send feedback, you agree that we may use it to improve DaySpeak, fix bugs, and respond to support needs.
Feedback should not include content you do not want us to see.
DaySpeak does not automatically attach journal text, transcripts, raw voice recordings, diary photos, or diary videos to feedback. Attachments are only sent if you manually add them.
9. Import and export
DaySpeak may allow you to import data from supported files or export your DaySpeak journal.
Import results may vary depending on the file format, source app, missing data, duplicate entries, unsupported media, or file structure.
Exports are created so you can save or share your journal data. Once you export or share a file outside DaySpeak, you are responsible for storing and protecting that file.
DaySpeak cannot control what happens to exported files after you save or share them outside the app.
10. Premium, trials, and subscriptions
DaySpeak may offer free features, trials, and paid Premium features.
Premium features may include higher usage limits, additional media features, enhanced transcription, insights, or other features shown in the app.
Subscriptions, free trials, renewals, cancellations, refunds, and billing are managed through the App Store, Google Play, RevenueCat, or another purchase provider used by DaySpeak.
Your subscription may renew automatically unless you cancel it through the platform where you purchased it before the renewal date.
Refunds are handled according to the policies of the App Store, Google Play, or the applicable purchase provider.
Premium features and pricing may change, but changes will not reduce rights you have already paid for during an active subscription period unless allowed by law or platform rules.
11. Acceptable use
You agree not to:
- Use DaySpeak for unlawful purposes.
- Interfere with or disrupt DaySpeak's services.
- Attempt to access accounts, systems, or data without permission.
- Upload malicious code or harmful files.
- Abuse feedback, support, import, export, or cloud features.
- Use DaySpeak in a way that violates another person's rights.
- Reverse engineer or misuse DaySpeak except where allowed by law.
12. Service availability and changes
We work to keep DaySpeak reliable, but the app or certain features may be unavailable from time to time.
We may modify, pause, remove, or add features as DaySpeak evolves.
Some features may depend on your device, operating system, internet connection, app store availability, third-party services, or subscription status.
13. Data deletion and account deletion
Where supported, you may delete content in the app or request deletion of your account and cloud data.
Some information may remain for a limited time in backups, logs, security records, purchase records, or records we must keep for legal or operational reasons.
Deleting the app from your device may remove local data depending on your device and operating system settings.
14. Intellectual property
DaySpeak, including its name, design, logo, software, interface, and other app materials, is owned by DaySpeak or its licensors.
These Terms do not give you ownership of DaySpeak's software, brand, or intellectual property.
You may not copy, modify, distribute, sell, or create derivative works from DaySpeak except as allowed by law or with our written permission.
15. Third-party services
DaySpeak may use third-party services for authentication, cloud storage, AI processing, subscriptions, crash reporting, analytics-free diagnostics, or other app operations.
Your use of app stores, payment providers, device services, or third-party platforms may also be governed by their terms and policies.
We are not responsible for third-party services that we do not control.
16. Disclaimers
DaySpeak is provided "as is" and "as available."
We do not promise that DaySpeak will always be uninterrupted, error-free, perfectly accurate, or available on every device.
We do not promise that transcription or AI insights will be complete or accurate.
To the extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow certain disclaimers, so some of these terms may not apply to you.
17. Limitation of liability
To the extent allowed by law, DaySpeak will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, loss of goodwill, or service interruption.
To the extent allowed by law, DaySpeak's total liability for claims related to the app or these Terms will be limited to the amount you paid to DaySpeak for the service during the 12 months before the claim, or [amount], whichever is greater.
Some jurisdictions do not allow certain liability limits, so some of these limits may not apply to you.
18. Indemnity
If you misuse DaySpeak, violate these Terms, or violate someone else's rights, you agree to be responsible for claims, losses, liabilities, damages, and expenses that result from your actions, to the extent allowed by law.
19. Governing law
These Terms are governed by the laws of [Province/State/Country], except where local consumer protection laws require otherwise.
If a dispute arises, we encourage you to contact us first so we can try to resolve it informally.
20. Changes to these Terms
We may update these Terms from time to time.
If we make material changes, we will update the "Last updated" date and may provide additional notice in the app or through other appropriate means.
Your continued use of DaySpeak after the updated Terms take effect means you accept the updated Terms.
